Class Packages and Memberships:

All sales on class packages and memberships are final and must be made in advance. We do not offer refunds on these purchases.

Membership cancellations require a 30-day notice. Please contact us in advance if you wish to cancel your membership.

In cases of illness or extenuating circumstances, refunds or credits may be considered on a case-by-case basis.
Merchandise Returns:

We accept returns on merchandise in studio within 30 days of purchase, provided the items are unworn and in their original condition. Please provide proof of purchase for all returns.
Class Cancellation Policy:

We require a minimum of 24-hour notice for class cancellations.

Cancellations made within 24 hours of the scheduled class will incur a $15 fee, and the class credit will be forfeited.

No-shows will be charged a $20 fee, and the class credit will also be forfeited.

If you encounter special circumstances, please call or text the studio as soon as possible, and we will do our best to accommodate you.
Limitation of Liability:

By participating in classes or using services provided by Foundation Pilates, you acknowledge and accept that physical exercise carries inherent risks. You agree to release and hold harmless Foundation Pilates, its owners, instructors, and staff from any liability for injuries, damages, or losses that may arise from your participation in our classes or use of our facilities.

Foundation Pilates is not responsible for any personal property lost, stolen, or damaged while on our premises.

Our liability, under any circumstances, shall be limited to the amount paid for the specific service or class in question.
Dispute Resolution and Governing Law

Governing Law: These Terms of Service shall be governed by and construed in accordance with the laws of the state of California, without regard to its conflict of laws principles.

Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms, including the formation, interpretation, breach, termination, or validity thereof, shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction. The arbitration shall be conducted by a single arbitrator with experience in the fitness and wellness industry. The location of the arbitration shall be in Orange County, California.

Waiver of Class Action: You and Foundation Pilates agree that any arbitration shall be conducted on an individual basis and not on a class or representative action. Both parties waive any right to bring a class action or seek relief on a class basis in connection with any claim.

Equitable Relief: Notwithstanding the foregoing, either party may seek equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
